A federal judge will allow three former members of the North Carolina Symphony to proceed with their lawsuit against the Symphony and the state Department of Natural and Cultural Resources. The musicians say they lost their jobs because they refused to be vaccinated against COVID-19.
US District Judge James Dever issued an order Thursday permitting portions of the lawsuit from Christopher Caudill, Rachel Niketopoulos, and David “Dovid” Friedlander to move forward, while dismissing others. He ordered the musicians and Symphony to engage in court-hosted mediation.
The three plaintiffs argued that Symphony President and CEO Sandi McDonald refused to grant them religious exemptions when the Symphony required all musicians to get the COVID vaccine in 2021. All three lost their jobs in June 2022.
