This case study illustrates how timely intervention and facilitated dispute resolution can help resolve workplace discrimination concerns while creating opportunities for employers to strengthen their understanding of human rights obligations.
A complainant engaged through an employment agency contacted the Commission after she was no longer offered shifts shortly after advising the agency that she was pregnant and requesting light duties. She described feeling humiliated after being sent home in front of colleagues and was concerned that disclosing her pregnancy had resulted in the loss of her work and income.
Recognising the urgency of the situation, the Commission engaged promptly with the employment agency to better understand the circumstances and facilitate discussions between the parties. Through the dispute resolution process, the parties explored their different perspectives and worked towards a practical resolution that addressed the complainant's concerns while allowing the employment relationship to conclude on positive terms.
